When California voters decide Proposition 8 this fall, they will likely check “yes” or “no” next to a ballot title that reads: “Eliminates the Right of Same-Sex Couples to Marry.”
A Superior Court judge Friday rejected a suit filed by Proposition 8 proponents against the ballot title proposed by Attorney General Jerry Brown. Judge Timothy M. Frawley said Brown’s language was neither false nor misleading, handing a victory to gay rights supporters who want an unequivocal statement of what a constitutional ban would do….
Proposition 8 opponents did succeed in forcing some changes to the text of ballot arguments filed by supporters. Frawley said Proposition 8 supporters would have to tweak their statement that teachers “will be required” to teach young children about gay marriage if the measure fails.
The argument should read that teachers “may” or “could” be required to teach about gay marriage, Frawley ordered….
